General terms and conditions of sale
**General Terms and Conditions of Sale (GTC) – Casa Charli**
HANNAH ISAURA GAUTHIER BOISFER, NIF 319890082, or PATRICE SERGE BOISFER, NIF 319889696, with a professional address at Rua Manuel Mendes 36, Aroeira, 2820-098 Charneca de Caparica, hereinafter referred to as the OWNER and/or HOLDER OF THE LOCAL ACCOMMODATION.
1. **Acceptance of the Terms**
By using the Casa Charli website to make a reservation, you automatically accept these general terms and conditions. The reservation confirmation is subject to acceptance of these terms and the payment of the reservation.
2. **Reservation Process**
– **Availability Check**: Availability for the house can be checked in real time on the dedicated page of our website. You can select your arrival and departure dates as well as the number of guests.
– **Reservation Confirmation**: The reservation is instant and requires full payment at the time of booking.
3. **Payment**
– **Payment Terms**: Payment is made online via credit card. For other payment methods, please contact the owner via the form on the “Contact” page or by email at contact.casacharli@gmail.com.
– **Security Deposit**: A security deposit of €1,000 is required as a bank imprint 24 hours before arrival and will be released within 7 days after departure, subject to the property’s cleanliness and integrity conditions (damage to property or furniture, dirt, or other disorder requiring special cleaning, or any other cost incurred by the Owner due to the Tenant’s stay). If the premises are dirty or damaged upon arrival, the Tenant must immediately inform the Owner.
4. **Cancellation**
– **By the Client**: Free cancellation up to 30 days before arrival. After this period, no refund of the reservation is provided.
– **By the Owner**: The owner reserves the right to cancel the reservation if the house rules are not followed, without a refund. In the event of force majeure or any other circumstance beyond the owner’s control, the owner reserves the right to cancel the reservation. In such a case, all amounts paid by the tenant will be refunded. The tenant cannot claim any additional compensation.
5. **Use of the Property**
– **Location**: The Local Accommodation property is a house with a ground floor and first floor with a courtyard and pool, located at Rua Adriano Correia De Oliveira, Nº 47, Aroeira, Charneca de Caparica. The property is rented with furniture and appliances.
– **Purpose**: The owner rents and the tenant takes on rent the house identified above, intended for local accommodation, for which license no. 157578/AL was issued by the Almada Town Hall, for the period provided during the reservation.
– **Capacity**: The maximum occupancy of the property is 8 people. Any additional person can only be accommodated with the prior consent of the owner. If allowed, additional charges of 10% per night per extra person will apply.
– **Duration of Stay**: The rental starts at 3:00 p.m. on the day of arrival and ends at 10:00 a.m. on the day of departure. Failure to respect the departure time may result in additional delay fees set at €100 per extra hour unless a different time has been agreed upon before the stay and accepted by the Owner.
6. **House Rules**
Compliance with the house rules, available on our website, is mandatory. Failure to comply with these rules may result in additional charges or cancellation of the reservation.
7. **Access and Inspections**
The tenant must allow the Owner access to the property for repairs, inspections, or emergencies. The Owner will exercise this right of access reasonably, giving at least 24 hours’ notice. The Owner reserves the right to access the property without notice in case of an emergency.
8. **Personal Data Protection**
Personal information provided will be processed in accordance with data protection legislation. You have the right to request access, rectification, and deletion of your personal data.
1. In accordance with no. 3 of article 9 and article 10 of law no. 23/2007 of 4/07, it is mandatory for any foreign citizen to provide an identity document to meet legal requirements for entry and exit from Portuguese territory. This obligation applies to all persons staying at the property. These documents must be sent by email to contact.casacharli@gmail.com, 7 days before the entry date to the property.
2. In accordance with the provisions of the Personal Data Protection Law, within the context of the new data protection legislation, both Parties give their express consent for personal data to be entered and processed in transaction control and reporting databases, within the context of this contractual relationship.
3. The parties are guaranteed, according to the exact terms of personal data protection legislation, the right to access, rectify, update, or delete their personal data, as well as the right to object to their use for the purposes described in the previous point, by indicating their disagreement.
9. **Legal Provisions**
– **Applicable Law**: This contract is subject to Portuguese law.
– **Jurisdiction**: For any dispute, the court of the location of the property has jurisdiction, with express renunciation of any other jurisdiction.
